By entering our cat lounge, all visitors agree to the following Release of Liability, Covenant Not to Sue, and Assumption of the Risk:
In consideration of being granted access to affoGATO Cat Cafe LLC, located at 761 Starkweather Ave, Cleveland, OH 44113,
I, THE ENTRANT, ACKNOWLEDGE AND AGREE TO THE FOLLOWING:
1. That I was provided a tutorial on the appropriate care of the adoptable cats, and notified of the common signs of irritation and aggressions that may be exhibited in cats. This tutorial must be completed before entering the cat lounge.
2. That interaction with cats can result in injury, including, but not limited to biting or scratching without warning or provocation. By entering the Café and executing this “Release of Liability, Covenant Not to Sue and Assumption of the Risk”, I am knowingly, voluntarily and willingly assuming all liability and assumption of the risk discussed herein, in the tutorial, and those related to interaction with the cats in the Café including, but not limited to bites, scratches, infections, illness, allergies, and physical, emotional and financial damages, some or all of which may be severe.
3. That the cats provided for in the Café come from all different backgrounds including, but not limited to, previously being homeless, stray, abandoned, abused, neglected and or have health or behavioral problems.
4. That you will treat the cats gently and with respect and appropriately watch for signs of irritation or aggression from the cats as displayed through the tutorial.
5. That though the Café strives to provide only those cats that have been provided appropriate and sufficient medical care, it cannot guarantee the health, mental stability, and/or the lack of parasites or any other attribute or condition of the cats on its premises.
6. If I sustain injuries requiring medical or other treatment of any kind for injuries, illness, allergic reactions, or damages sustained directly or indirectly as a result of entering the Café or any activity involving or related to animals at the Café and/or it’s associates as defined below, I agree to be fully liable, legally, financially or otherwise for any and all costs, expenses or other burdens incurred as a result of such care.
7. I fully understand the potential for risks and the conditions indicated above and hereby agree that I, on behalf of myself and my heirs, executors, guardians, administrators, legal representatives, successors and assigns, promise to not bring, support, or cause to be brought any claim or action, legal or otherwise against affoGATO Cat Café, LLC, its owners, employees, volunteers, agents, partners, the Cleveland Animal Protective League.
8. I agree to indemnify, release and forever hold harmless the affoGATO Cat Café, LLC and its owners, employees, volunteers, agents, partners, the Cleveland Animal Protective League, from any and all claims, losses, expenses, attorney’s fees, damages and liabilities, including claims of negligence, related to any physical, mental or psychological impact, illness, allergy or injury and any economic, physical, personal property or emotional loss that I may suffer.
9. I understand that any injury or other outcomes may arise from my own or others actions, inaction, or negligence and I nonetheless assume all related risks known and unknown to me.
10. I am over the age of 18.
IF ANY GUESTS ACCOMPANYING THE ENTRANT ARE MINORS, THE PARENT/GUARDIAN MUST AGREE TO THE FOLLOWING:
I, the parent or guardian of the below listed participant(s), with authority over the care and wellbeing of the below mentioned individuals, will be fully responsible for the juvenile participant, and I am assuming the conditions set forth above for myself as well as the below named individuals. I will be fully responsible for the juvenile participant, and I am assuming and accepting the assumption of risks as described for the following juveniles.
